Medical Malpractice Wrong Medication

3 yrs ago, I went to see a dermatologist with a skin condition called Dermertographism and he prescribed Hydroxyzine, which I was to take 4 times a day for years until my condition improved. I took the prescription to CVS and received Hydralazine which is medication for Hypertension. I took this medication for 2 years but became suspicious when my condition did not improve. I later discovered that CVS gave me the wrong medication which I had been refilling for 2 years. I am fairly young and now I get anxiety attacks as well as continuous, periodic, migraines. I received an apology from CVS and chose to ignore my problem hoping it will eventually go away but it has continued to persist. My PCP advised me to rest and exercise more but this is yet to solve anything. I went to the emergency room previously and they prescribed ativan, an anti-anxiety drug, but I discontinued taking it, as it is addictive. Can I file a Law Suit and receive compensation ? I have records of all prescriptions and transactions.

This isn't such an easy suit to bring since there aren't physical signs of damage and I am wondering if you can show that you suffered actual damages, e.g. you ended up going to 2 other psychologits, specialists, etc.

Let me ask you this - what medication did you recieve? How did this mix up occur? How did you discover years later that you had received the wrong medicine?

I don't want to sound skeptical but remember that there will be a defense attorney who will say "no harm no foul" and will challenge all your claims and tag you as an opportunist. I hope you're feeling better though.
