Medical Malpractice wrongful death if heir dies

my sister in law had a malpractice suit against a doctor. when she died, my brother (her husband) changed it to a wrongful death.her father was also in on this suit. my brother died 3 months later. in his will he left any award he would receive divided among three people. the lawyer said that with his death, the only one who may receive any type of award is now her father since he is considered her only heir. is this correct? fyi :he said my brothers only losses would have beeen spousal (lost of affection , etc.) and it would only have been for 3 months. they were both on disability so it would not be loss of income. also the doctor had no malpractice insurance and was being disciplined for drug abuse, so he had little assets.
