Possible pre-existing loans found on preliminary title report need to resolve

That is true. It is up to the county to get the liens removed before issuing the tax deed. This was obviously not done. Now you have to get a copy of the tax deed from your seller or the county to see if the loan liens were extinguished but not recorded.

    Easement/Trespassing

There may not be any languish granting the easement. It may be an easement by a recorded subdivision plat. If the state subdivided the land in 1947 to sell parcels and depicted the easement on the plat to get to a landlocked parcel and then recorded the plat, the easement to the back lot is a...

    Easement/Trespassing

Well technically the property is not landlocked because of the easement. If not for the easement the property would be landlocked. And that is why that easement will never be extinguished. It is against public policy to create or have landlocked properties. My guess is that buyers of...

    Easement/Trespassing

I would like to know where you get the notion that a utility easement cannot be granted to a private estate? Adverse possession has nothing to do with a granted easement. I would be willing to bet that back in 1947 an access easement for the property behind you was granted that also included...

    Easement/Trespassing

Assuming that up is north and OP's property is in the center of the parcel mapper, it appears that the easement starts on the northern property and then cuts back onto OP's property.

    Shared well

It would be illogical for someone that paid an assessment for a water infrastructure extended to serve a new area and then paid all the costs for hookup to the City's water company to go back to the well. What possible reason would there be? Why did they hookup in the first place? I would...

    Removing Deed Restrictions

The bolded line above makes the covenants and restrictions appurtenant to the land. That means that no matter how long or who owns the property the restrictions are part of the land. And since the deed says that the restrictions automatically renew every 10 years, it means that the attorney...

Removing town representatives who are not representing

While you may not recall your elected officials you can fight the development on zoning and planning grounds that are regulated NC statutes. The Town Council can't just change the comprehensive plan or the zoning ordinance because they want development to generate retables. There is a long...

DOES AN HOA HAVE TO BE REGISTERED AND HAVE DOCUMENTATION.

I disagree and I have no idea from where you draw that conclusion. The Act applies to all HOAs as the case law indicates that it applies to subdivisions of single detached housing. And it doesn't matter if the HOA is for profit or nonprofit or LLC or unincorporated.

DOES AN HOA HAVE TO BE REGISTERED AND HAVE DOCUMENTATION.

It's all spelled out in the Tennessee Condominium Act of 2008.

Can Zoning Dept. Change Zoning on a Property Currently Up for Sale If It Hurts Sale?

What you describe could be what is called spot zoning which is not legal. That is where a parcel or several parcels are zoned differently then the surrounding parcels. There are plenty of cases in Louisiana case law if you want to read up on the subject. However, it might be that a zoning...

    Unscrupulous Roofer

Judge, that is not correct. A mechanic's lien holder may foreclose on the lien and force the sale of the property.

    Seller failed to disclose

The year a house was built is not a defacto determination that there is a lead paint hazard in the house. For one thing the house may have been renovated or portions have been renovated. Old lead paint may have been encapsulated with latex acrylic and is not exposed. It is only when work is...
