Hi,

I am a 25 year old male who just got engaged to my 21 year old female fiancé. She is premed and will enter medical school after we get married. I do not have any debt but she will take out medical school loans during our marriage. Do I need a prenuptial agreement to protect me from her future medical school debt?

Thanks

However, there are a few situations where you can be held liable for your spouse's debt, or you will be directly affected by it. When any kind of debt is taken out in just one person's name, it is only that person who is liable for the debt. Creditors will try to convince parents and spouses that they are liable for someone else's debt, but if this happens it is generally a lie and you should contact an attorney about possible actions against the creditor.

Are you Liable for your Spouse's Debt?
...

No. Might it be desirable? Maybe. Do you have significant assets and income?

Frankly, I'm not sure why this is a matter of one or the other of you "getting a prenup". Why don't you both develop a mutually agreeable plan to cover the matters you are concerned with? That way it's not an adversarial matter, rather, it is the two of you creating a roadmap for your future together that takes in to account as many of the possible points of contention that you can envision and provides a guide on how those situations should be handled.
