Can't Get Family Member to Move Out

My brother and I inherited our mother house after her death. My parents are divorced and my father was living elsewhere. In order to help my father, we asked him to housesit until we decided on whether to sell the house. After about 8 months, and paying all the utilities bills, taxes and maintenance, we decided to sell the house.

We asked my father to move out and he has refused. After four months of wrangling and the threat of eviction, he asked if we would sell the house to him. The offer was well below the market and had a bunch of unrealistic contingencies. We rejected his offer.

We have now sold the house and asked ot move out and he refuses,

Do we really have to go to court to get him out?

Oh by the way, withour telling us he asked his girlfriend to move in with him. One month the electric bill was over $500.
 
You will have to proceed with an eviction to get him out. Even if there is no lease, after being there for awhile, he has tenants rights.
