Roughly a year and a half ago (June 2005) I made several transactions totalling about $10,500 on Firepay.com. Due to unforeseen circumstances, the money that was allocated for the EFT's had to be used prior to the transactions clearing my bank account. The charges came back to Firepay.com for NSFs. I worked with Firepay at the time to reduce my the amount owed by $4,000 bringing my balance to $6,000. I did not have the means to reduce the balance any more at that time. The account was placed in collections through a 3rd party. I was contacted once or twice regarding the matter through the 3rd party but did not have the means to pay back the funds. I received a call yesterday from Firepay saying that my account had been given back to them due to a lack of payment. They offered a settlement of $3,900 due by January 19 otherwise they are threatening to report me to the authorities for check fraud and take litigation against me to recover their funds. I told them that I would be able to pay them off slowly and could come up with a few hundred dollars in the next two weeks. They refused and said the only choice I had was to pay the settlement or be reported. Is this a scare tactic or something that should be taken seriously? The NSF transactions were involuntary and could not be avoided at the time. Is there a statue of limitations for reporting such activity to the authorities? Any advice is greatly appreciated!
