Claimed Son on taxes

I have a friend who has been divorced for years and has two sons. Her husband is supposed to claim one and she is to claim the other. While he was behind on his child support, she claimed both. He has reported her to the IRS and now the FBI is involved talking of criminal charges. They said that she should have obtained a letter from the IRS before claiming both with proof that he was behind prior to claiming both. Has anyone heard of this happening and if he was in arrears why would she be charged criminally?

She still did not have the right to claim him on taxes unless the decree specifically says that of he is being in CS she can claim. She will likely owe him part of her refund, I suggest she offer it to him to clear this up and see if he is willing to drop it. Also since she claimed the child she was not supposed too, she probably got a stimulus check for the child BUT if Dad was in arrears in 2007 (not 2008) she may have gotten the stimulus intercepted anyways. As far as the FBI, this probably is not true. If this is a threat from him I would ignore it. This is not a federal offense but she can be held in contempt through family court. Is an actual FBI agent involved? I have never heard of the FBI getting involved in a dispute between exes. Stuff like this happens all the time.
 
The FBI has contacted her twice and is stating she could go before a grand jury and be charged criminally for doing this. This sounds crazy to me. Her ex contacted the IRS and then the FBI is in contact with her. This is out of her ex husband's hands now and she can't negotiate with him directly. They told her not to contact him. They have been in civil battles and he did this in retaliation. He has a history of physical abuse and this was a way of trying to hurt her.
