Assault & Battery Close in Age Exemption in FL

I am the Xena that jacksgal mentioned. My son is in prison and has been for almost 10 years, he has 5 more years to go.

OP, do you remember a girl by the name of Carly Brucia? She was raped and killed by a sex offender. Not long after that, a girl by the name of Jessica Lunsford was raped and killed by another sex offender- both were in Florida.

If you remember them, maybe you will remember that our governor and legislature come out and vowed that they would make sure that Florida will be known as the state that is hardest on sex offenders. They have made good on that promise. Even though the law seems to read one way, any person who is 18 or older that has sex with any person younger than 18- even if they are 17, WILL go to prison and forever be labled as a sex offender.

Now, some might say that's not too bad- however, my son was out on probation and his home was burned down after the police notified all of his neighbors. Do you think the police did anything to catch the person/persons who committed arson? NO, why- it was because the arson was committed against a registered sex offender. If you would like to hear more horror stories about what a sex offender's life is like in Florida, I'll be happy to fully fill you in.


I would urge to contact Xena and see that the 19 year old is far from escapng trouble if the illegal sex continues
 
My overall advice is to tell him to be careful and keep a sexual relationship in the future -If they don't have sexual contact there is no crime. Sexual based offensive are tricky, one of the beautiful and sometimes ugly thing about laws is that they can be twisted -thats why we have lawyers who made big money to manipulate the interpretation of the law or do it as best they can and some do it well. I totally disagree with everyone who are calling these people sex offenders because of 2 year difference these people are not pedophiles how many of you have a wife or husband more than 1 year off? dose that make you a sick person? -no it doesn't and it doesn't make these people any less of a person my girlfriend is almost 3 years younger than me so damn I'm apparently relay messed up huh? even though we are both consenting adults -this whole post has been nothing about abuse that has been directed at these people and its ridicules. So advise him to keep a sexual distance for the next year and everything is peachy cream- as for the rest of you oh-so-holy godsends you should rethink your morals if you think they are bad people for being 1 or 2 years off.

Perhaps Florida law is designed to keep children such as yourself safe from being raped by people like me? tsk tsk.. children children.. research a bit before you pull things out of your ass, eh?

@mmms, your thoughts on your son's legitimate relationship are correct. Florida law states that the age of consent in Florida is 18, but that a close in age exemptions exist. By law, the exception permits an adult under the age of 24 to engage in legal sexual activity with a minor NO YOUNGER than the age of 16.

Florida code said:
794.05 Unlawful sexual activity with certain minors.-- (1) A person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree.
meaning, 16 to 23 is legal. she could be 16, he could be 23.. so long as it's consensual.


@xena, perhaps your son had sexual relations with someone under the age of 16, or was younger than 16 at the time the sexual relations took place? Or, seeing that it has been ten years since this took place, perhaps this close-in-age exemption has only recently been added to the books?

..eh, just thought I should revive this year-old discussion to ease the unnecessary motherly worries of mmms..
Speaking of which, how are things between your son and his girlfriend, mmms? (...ex-girlfriend?)

I am aware of Xena's sons case she was 16! He was charged under lewd acts laws not statutory rape. So charges can be filed that will result in jail and registration just not under rape laws
