Assault & Battery defendant sent threat...Can I report to police?

Im taking a former friend to small claims court. Another mutual friend deleted the defendant from his facebook friends list and he contacted this mutual telling him "you deleted me because john is talking crap about me" etc etc etc...He went on to say "when I see him, im going knock his teeth out"

He's just upset hes getting sued and is talking smack.....BUT

Is this something I should report to the police or do I have to wait for him to actually assault me?

If he does, what kind of charges can be brought against him?

If he batters you, you can make a police report.

As far as what was told to you, that's hearsay.

I doubt that any police agency would act upon third hand, unsupported rumors.

If you feel it is necessary you can get a restraining order. So far nothing criminal has happened though. With a restraining order in effect you don't have to wait for him to knock your teeth in for the police to get incolved... but it may not stop him from trying.
