divorce & foreclosure

my husband & I are separated but neither of us has filed for divorce. He purchased a house before we were married and I am not on the mortgage. The bank has started foreclosure action against him and I just found out that my name is also on the lawsuit. Is there anything I can do to get my name off. My name is NOT on the original mortgage.

Is your name on the deed?

Even if it isn't, you may be a party in interest so you have to be named in the lawsuit.

no it isn't. should I file for divorce, everyone is telling me that if I just file the papers it will stop the clock on any legal action he's involved in that could affect me.
