Eliminated Position actually Reassigned.....Do you know....

My manager's position was eliminated in June under the pretense that her job was being absorbed into another department. As a result my position was also recently eliminated. I have just learned that in fact a new person will be taking on her responsibilities and that my position was not actually eliminated, but rather "reassigned" to another as well. Does this give me bargaining rights to request extended severance considering my outstanding performance throughout and present poor market conditions? Thank you for any helpful advice!
 
You don't know if the position that was reassigned has the same job description as the one you used to have (at least that is not what the post reads) but even if it did, it is still not illegal for them to do what they did. The answer to your question is no, it does not give you rights to request extensions due to your oustanding performance and to present job market conditions. Good Luck to you!
 
Many people misunderstand what is meant by a position being eliminated. It does NOT mean that the duties of the position no longer have to be accomplished; simply that there not going to be as many people working there. The duties still have to be done and a different person will be doing them, probably along with the duties they're already doing. A position being eliminated really has NOTHING to do with the job duties, but solely with the employee count.

So no, the fact that someone is still doing those duties does not give you any kind of bargaining rights.
