I started an internship with Aamaya by Priyanka Lugani. It was agreed in writing that I would receive a £500 monthly salary. I obtained this internship through the European School of Economics, where I had been studying a certificate course. The internship was terminated one month early, with one week's notice. My salary was withheld unlawfully and the mental anguish I went through lives in me up until today.
Reasons for early termination:
1. The company director, Ms. Priyanka Lugani, with whom I worked closely exhibited irrational behavior that created unbearable work conditions. Within two months, two interns quit, and three interns filed formal complaints with the university. I was pressured to pay £107 from my personal bank account for the director's China Visa, which felt like extortion for a student. I can provide multiple examples of such conduct.
2. Although my agreed role was different, I served as the director's personal assistant. Many emails were sent and signed with my name without my authorization, some containing rude content and poor grammar., which embarrassed me. I have evidence that Ms. Lugani sent these mails under my name. After a final incident, I felt very uncomfortable and clearly informed Ms. Lugani before giving one week's notice of resignation.
Ms. Lugani refused payment because:
1. She believed I defamed her company by speaking negatively about her to her agents.
2. She claimed I breached a non-disclosure agreement by seeking employment through her contacts. The non-disclosure agreement, which I was not presented with remained unsigned by me. She refused to pay until it was signed. I did not agree with the terms.
3. Ms. Lugani alleged I breached a contract by giving only one week's notice instead of two. She referenced a contract which predated my first day at the European School of Economics and my knowledge of the company.
Questions
Did I have a case for Small Claims?
Did Ms. Lugani have the right to withhold my salary?
