I have been seaperated from my wife for a couple of years now, but have not divorced yet. When we were together, I purchased a truck and we had it financed in her name only. I have been paying the payments ever since. Every month since we split up I send her a money order for $350.00 and she, in turn, pays the payment. Today I found out that she has not paid the payment for the past 3 months even though I have been sending her the money on time. I am working something out with the finance company so that I do not lose this vehicle but I am wondering what I can do to get the $1,050.00 in payments from my ex that she wrongfully kept. I still have all money order reciepts to prove I sent the money to her. Is this theft? What legal action can I take against her? Thank you for your time.

1st off you need to try and get this truck in your name only ( refinance )or you will have future troubles w/ the ex on the ownership of the truck.
2nd you will have to more then likely sue the ex in small claims court for your $$ back--try and due some due diligence in collecting it first from the ex-- by calls and certified letters. Then if she fails to follow thru you will need to small claims her for the $$.
