Ex-wife making life hell on earth

My stepson is a divorced father of a 6 year old daughter. His ex lives with another man and has a daughter by him. She has a restraining order on my stepson and will not allow him to see his daughter. He is working and paying child support. At Christmas time she texted him. He texted her back and she called the police and had him arrested. He had his first court appearance and asked for a court appointed attorney but was denied. He can't afford an attorney so he feels he has no chance to ever see his daughter again. His ex and her boyfriend rented a house a half mile from my stepson so she could keep an eye on him and harass him. She has a violent temper and is on medication for Bi-polar disorder. She is making his life miserable. He is a good dad and misses his daughter. Is there a legal aid in Minnesota that may be able to help?

Hopefully he kept both text messages. They will assist in his defense. But, doesn't he understand that he is to have no contact in any firm with her? If not, you need to explain that to him.

He must earn too much money to have a court appointed attorney. He can ask the court for a court appointed attorney, again. If he isn't successful, I suggest he hire one. Maybe you and his mother can help him financially? Otherwise, he's going to get a rather rude awakening!

Thank you for answering my post. My stepson did keep the text messages. He showed them to a court official and the guy said that many ex wives do that to their ex's to keep them miserable. I think he learned his lesson and won't attempt to contact her again. His mother and I are living on social security alone and we have no money to loan him. He doesn't own anything but his truck so he can't borrow money. Thank you again for the advice. He just wants to know if ex husbands have any rights. Evidently not.
 
Evidently he makes too much money. He drives a delivery truck four days a week and they must not take into account what has to come out of his paycheck. Support comes first and it takes most of what he makes.
 
Maybe all of you can put your funds together to get an attorney for him. Just because though he has a restraining order from mom does not mean he cannot see his son. They can arrange some visitation. He needs to at least have a consultation with an attorney, or contact a fathers rights groups in his state and see if they can even help him file on his own. If Mom texted him first the RO sounds like BS. He deserves to see his son unless it has been proven he is a danger to the child. If he cannot file any legal help then he needs to go down to the courthouse and file on his own and ask for a meeting place to be arranged to someone can drop the child off to him.

He needs to do something otherwise mom gets away with her nonsense and he doesnt see his child.
 
Duranie- Thank you for your comments, I will try to locate a rights group for him and try to find out what he needs to do to file for visitation rights.
