If a persons tree falls on a neighbors car and damages the car and that same neighbor files a lawsuit what should this person do about the lawsuit

If I owned the tree that fell on my neighbor's car damaging the car, I'd report the incident to my homeowner's insurance company.

The insurance company should take care of all claims making the victim whole once more.

I would then NOT get sued.

If you don't want to do that, you simply go to court and prove to the judge why you aren't responsible for the damages caused to the neighbor's car.

Tip, unless the neighbor was cutting down your tree and he caused the tree to damage his car, your defenses are scarce.
