My jurisdiction is: Colorado

My husband and I moved into his sisters house mid august of 08 after she had offered us a place to live until we got back on our feet as we were almost homeless. Now, my husband and his sister are fighting all the time like kids of stupid things like picking up dog poop, or cleaning the kitchen, etc.

My sister in law had verbally agreed to let us live here until 12-31-08 rent free since we are broke. Now because they are fighting, she posted on eviction notice on our bedroom door that we have to be out tomorrow unless we give her our TV and not press charges against her dog who bit my husband the other night after he walked out of our bedroom. If we do as she asks, then she said we can stay till the 31st of October.

If we dont do as she asks, then she said she will go get a restraining order on my husband and get us kicked out tomorrow because he and I cant live there if a restraining order is in place, which will leave us literally homeless.

What can we do? Is my sister in law in her legal rights to threaten us like this just because she is mad at my husband? If we sign this letter she wrote up then that means we have to give her my big screen tv and not press charges for the dog bite which broke skin and caused him to bleed.

Help please.

Attached is information on evicting someone in Colorado...

Has your sister-in-law been to court and been granted an eviction? If not, she can't do a "self-eviction". She can present you with a notice to vacate in 3 days and if you don't comply, THEN go to court and file for an eviction but only a court can grant an actual eviction.

What grounds does she think she has in regards to filing a restraining order against your husband? Have these disagreements reached the violent stage? As a general rule, law enforcement will not get involved in what they consider civil issues but they will often step in to remove someone if there is a concern over threats of violence, domestic abuse, etc..

P.S. This entire family business doesn't sound good. Have you considered selling the big screen TV so you'll have some funds that would perhaps allow you to find your own place to live?
