Ok so a contact order has been issued his grandma bonded him out and we don't have court until 28th but they only have 3 witnesses not our passenger... Why is that

His lawyer or public defender will have to be told about your witness.
Your witness is a defense witness.
Make sure you tell his grandmother how to get in touch with your guy, so he can tell his lawyer what he saw.
You need to be on the witness list for him, too.
Make sure granny lets his lawyer how to reach both of you.
