My fiancee and i are going through a drawn out costody cas. We had costody of her child for the first 4 years of the childs life. she finally filed for child support in 2005 and the father got a lawyer. we were served and had two days to get a lawyer wich we showed to court without. The father had nothing to with the child for the first 4 years. He has been arrested for drunk driving and for 3 other charges. The first judge awarded him temorary costody
because we let the child play video games and he was sleeping in the same room. we got a lawyer and finally got a court date after 1 and a half years.
in the past year the police have been called to the fathers home for demestic disturbinses and one call for child abuse were the perimedics were called. we presented all that evidince to the judge. the only evidince on us was that my fianccee is still married to another man and that she had filled for food stamps. the judge ordered joint costody and the father keeps the child. What are are options now

There are lots of holes in this story. How did YOU figure into the child's first 4 years of life? When did your "fiancee" marry the other man? How do you know about the father's domestic disturbances? Why are you buying video games when you can't afford a place with 2 bedrooms, nor food?

I suspect that the judge found the father to be a more stable influence for the child. I also wonder if visitation was withheld from the father. I also wonder if you, the boyfriend, behaved in court as though you have some legal standing.

For future reference, you did not have custody of the child. The mother had custody. You just happened to be there. Also, you cannot have a married fiancee. If she's already married, then you cannot be engaged.

The mother's options at this point are to exercise her visitation.


ETA: Sorry to be so negative, but your post doesn't add up. If the evidence you have about the father is true, then there must be other factors that the 2 judges considered when making their decisions.
