I just found out that the house I am renting is in default. Some one come to the door(I assume from the mortgage company) checking to see if the house was empty or occupied, That is when I told them I am renting the house. I was told that the mortgage had not been paid in two months, and that the owner had 30 days to bring it current. Here is the thing. My rent is due this week. Do I pay the rent or start finding a place to live? The owner on the paper is not who I pay the rent to, or who I signed the lease with. What can I do? What are my legal rights as a tenant? Please help, I don't want to pay the rent if I am going to have to move soon.

Have you tried calling your landlord and asking about this? If he knows he is going to lose the house, he should give you some sort of warning. i would still pay rent because he could always get caught up but if it turns out you do have to move, you would have to sue him for any damages you have incurred.

I have called the "Landnlord", or I guess at least the person I pay the rent to. I am still waiting a response. The thing that has me worried now is that the person the mortgages name is in, is not the person I pay the rent to. I understand that the guy I pay ther rent to could be handeling the property, but what if the owner, or the person the mortgages name is in filed for bankruptcy? Why am I then still paying rent when obviously the mortgage isn't getting paid. Help!!
