In 1999 I used my mother's information to secure several credit cards. I did so with the intention of paying them (I did), but when my mother found out she had them removed, they were transferred to me, I continued to pay them until I filed for bankruptcy in 2000. No charges were ever filed against me.
A few years later I received an American Express card in the mail, and since my credit was cleared up due to the bankruptcy several years prior, I had no reason to believe it was not my own. I charged on it and paid on it for nearly two years.
Recently I helped my mom look into buying a second home. I was shocked to see the AMEX bill on HER credit. I told her about it and that I would send a letter to the credit bureau's on her behalf to have it removed. Apparently that did not fly with them. I don't mind having it transferred into my name and paying it, although I am quite behind and it's about to go to collections.
My question is - does anyone know the statute of limitation on identity theft in Oregon. I know I am 100% responsible for this and will do what I need to, to get it taken care of. Most of all I want it removed from my mom's credit. Unfortunately she is out of the country for a few more weeks and I don't think AMEX believes me or will wait that long to speak to her.
I've thought about going down to the police station myself, can I file a report on behalf of my mom when I am the criminal? Should I? The account was opened in 1999 and the charges are from 2003. I was paying on the card throughout 2003 and 2004. Any help would be appreciated as I don't have much money.
