I just recieved a letter from a law offics that Im beening sue from county court. for a truck repo. can I be seud county court I thought it was to be in j b court. the lew offices sad that tha can take my home and pay chack bank acc.
Okay, you reside in the greatest state in the union, Texas.
That is very good, when these creeps try to sue you.
Bad news, yes, you can be sued in county court.
Very few attorneys waste their time suing anyone in JP court.
But, the good news is, that is Texas; your personal bank account can not be levied against to satisfy a civil judgment relative to personal debt.
The other good news is, no, they can not take your home.
They can place a lien on your home.
But, that will not cause you to be evicted.
In Texas, a debt owed to a private party can not be used to foreclose against your home.
In Texas, we are protected by Homestead Exemptions.
These Homestead Exemptions are rooted in our state's constitution.
So, here's is what you do.
If you're sued, attend every court date.
All you need do, if they sue you, is DENY everything.
Do not admit to ANYTHING.
If they persist, ask them to produce the original contract they allege you signed.
They won't, because they can't, because they don't have it!
Going forward, STOP communicating with these creeps.
Change your telephone number.
Tell the telephone company you want your number changed because you've been receiving lots of harassing, annoying, prank calls.
They might waive the number change fee.
Tell them that you want an unlisted, unpublished number.
Tell them to provide no information about the new number to anyone, and do not provide your new number in the termination message for the current one.
Do NOT give your new number out to ANYONE.
If someone requests a number, just give them your old one.
Don't even give the new number to the pizza delivery guy.
If you give it to relatives and friends, tell them to NOT share it with anyone.
If you receive papers for court, served by a deputy, simply follow the instructions on the subpoena or summons.
Remember, DENY, DENY, DENY; and do not speak to these crooks again!
They are trying to intimidate you into paying something you no longer owe. or maybe never owed!
