Last year when I moved into my apartment, the lease I signed had my rent listed as $1212/month. The online portal each month had a concessions credit of $212. So essentially, I was paying $1000 a month plus fees such as trash, water, pest control, etc. About 60 days before my lease was to end, I received a renewal letter raising my rent to $1212 basically removing the concessions if I signed a 12-month renewal. I never signed or answered the letter or agreed to the amount. When I went into the office to renew, the lease the lease that both I and the leasing agent signed had rent at $999 a month. There was no discussion of this as I didn't notice until I received the signed lease from the agent. When I went back to the office yesterday as the portal only showed prorated rent for the 19 days at the old rental amount, the person at the front desk said that it would be whatever I was paying before as no one's rent was increasing this year, however when I spoke to the person that signed the lease as he was the only one that could add the amount for the full month, he told me as I was leaving to remember that my rent would go up in August.
My question is, can they raise my rent to $1212 if the lease that I just signed says $999? Normally, I would think not, however can they argue that it was in error and they have the letter that they sent regarding the renewal stated the $1212 so that was the intent and that I was made aware of the increase?
