Mistaken notice of deficiency

Thank you for creating this forum, I have no idea what to do.
I became disabled 2 years ago, went through all the courts, etc., and was red-flagged by the state dept. of taxation in the process. I assume this because I also was served jury duty in the process.

They sent me a notice of deficiency for NY state taxes from 2004. However, I lived in Oregon in 2004, my wife moved back to NY at the end of December 2004, and I not until January 2005. I sent them pages and pages of evidence including leases, W-2s, even bank records proving that I was in Oregon until January 2005 documenting this. I should point out that I unfortunately misplaced my tax returns from that year, although I did produce a receipt of tax refund from Oregon.

Recently, I received on the same day another notice of deficiency, and a separate Correspondence Acknowledgment Notice, complete with Protest ID.

My questions are how should I proceed? Should I redo the new notice of deficiency, considering they acknowledged my last one? Will I need to hire a lawyer to prove my case? What would be a cost estimate for such a thing?

Any advice will be most appreciated. I know I'm a first time poster, I've never had to deal with any legal issues before (less SSI) so I only found this site today. Thank you all for creating such a wonderful service!
 
Q: Should I redo the new notice of deficiency, considering they acknowledged my last one?

A: Yes; and get the copies of the Oregon return.
