I have worked in PA for 3 yrs now. I reside in Maryland. My place of employment is urged to change there brakes do to this law; as of Oct 1 they are giving us a 15 minute brake. The location of the brake area is a 5 minute walk away from my work station. As of JAN 1st 09 the plant is Tobacco Free! I weld for a living without PROPER Ventilation! A STATEMENT FROM A JUDGE ( CLEVELAND -- Judge Confirms in Written Order That Welding Fumes Can Cause Parkinson's, and That a Jury Could Find Industry Warnings to Be "Grossly Inadequate and Possibly Even Misleading" )!!!!!

My point and question: If I smoke thats my choice & problem. I understand they have to follow the Law we all do.

Who or What can I petition to get law (35 PA. STAT. §§ 1230.1 & 1235.1) over turned, or to get a permanent smoking area at my place of employment????? Should it be HR or the Board of Directors or Director, Corporation Bureau (Richard K. House) or these guys, Bureau of Professional and Occupational Affairs PLEASE HELP!!!

Thanks for your time

Doubt you will get it overturned, these laws are very popular and PA did a lot of review and debate before finally passing and instituting it.

So why are you worried about welding fumes, when you smoke?
