Parking lot accident rental reimbursement

I was in a parking lot accident , not at fault. Insurance refuses to pay my full rental reimbursement. Accident in Ga . I have liability insurance and I added Collision Damage insurance to the rental as my personal insurance would not cover any damages or accident in my rental if I were to get into an accident. Allstate says under Ga guidelines they don't have to reimburse me for rental collision insurance. But then I would be an uninsured motorist under ga guidelines. They also refuse to reimburse me difference on rental as I was given a car above the rental rate they allowed but was the only comparable car they had which was smaller than my car . But due to an event in ga it was the only available vehicle at the time. They will only cover their rate. Am I wrong but I should be fully reimbursed as I would not be in this situation needing a rental or insurance on that rental had I not been hit by their client and should be fully reimbursed. To that an insurance company telling me they will not reimburse me to insure my vehicle due to some ga guideline they did not specify on is crazy to me.

There's two issues. The rental rate they allowed you and the extra insurance.

Insurers often have agreements with rental companies for discounted rates. The rates you were allowed are probably rates that they have arranged with the rental companies. You should have been able to rent a car at that rate so you aren't entitled to a higher rate.

The extra insurance you bought was an option. The at-fault driver does not owe you for options, only for the basic cost of the rental including tax if charged. You could have rented the car without the optional coverage. That you thought it was necessary doesn't obligate anybody else to pay for it.

It's not just a GA thing. It's basic negligence law.

Do you have Rental Reimbursement coverage on your own auto policy?
