I need some help with my charges that are being placed against me. I was in my barracks room when the military police came in and requested to search my room due to a report of drug use in the room. I gave consent to the MPs to search my room as they were tearing everything out of my closet I withdrew my consent. They then contacted my commander asking for his consent. I went back into my room and locked the door and flushed what I had and came back out of the room they placed me on handcuffs and told me to sit down. They called CID to search my room CID found little baggies and don't know what else. The room is a open room with two soldiers. They then drug tested me for spice the following Monday. This happened Saturday at 1700 (5pm) on Sunday my 1SG came into my room and degraded me telling me I was a worthless piece of s word that he hopes I got to jail and he doesn't care if I rot in there and die and that no body gives a f word about me anymore. They have a 24/7 watch on me and making me sit in a conference room all day during duty hours and cannot see my wife or child (newly married) or speak to my family in private I was made to sit where people could hear me talk on the phone to my mother. They said 3 different things of why I'm being watched. I'm a flight risk (risk of going AWOL) also said because of suicidal thoughts back at NTC which I went and got treated for and or because I was being investigated. I was told by my chain of command that I need to make a sworn statement and I did detailing what happened that I tried the substance. I haven't been given a chance to eat 3 meals a day only one and that's lunch. They are making me stay in my barracks room the whole 4th of July weekend and won't let me spend time with my wife and child on a holiday. I have not been punished through UCMJ cause investigation is still going on. The baggies were empty and I haven't been in my room for a month due to ft. Bliss training and then halfway through emergency leave. They wrote false sworn statements about me which they all got their stories straight cause they all sat down together and wrote them together. I'm being charged with article 92 disobeying a lawful order article 34 obstruction of justice which they don't have any proof all but a picture of the toilet with sediments in it and article 112a possession of drug wrongful drug abuse. It was my first time using the substance. The reason why I used was to get out of the slump I was in due to the military not taking care of me until a year later my mother having breast cancer and my cousin passing away. I was wrong I know and I know I shouldn't of done it but the army medicine wasn't helping me only making things worse. What can I do about this and or are they allowed to keep me confined to my barracks room even though I'm married and have a dependent?

Ask to speak to a lawyer (JAG). You have a right to military counsel. You are also required to obey lawful orders. Yes, all of thi stuff is lawful.

Your consent to search likely was not even required in military barracks. Its been awhile since I have been on a military base, but last I knew all persons were subject to search at any time while on base.
