My sister has had durable power of attorney over my mother since 2003. I believe that my sister only got this ''power'' so she could essentially defraud my mother out of her pension. my mother suffers from some dementia, so i truth she cannot manage her money properly. But that is all the more reason that my mother should not be defrauded . Also I took care of my mother and my aunt Stell . For the time of over a year that
I took care of my mother at my aunt's house my sister never gave my mother or myself a single penny. Allso for over two years of taking care of my aunt my sister never gave me a single penny and she cleaned out my aunt Stell's bank account , almost never brought food into the house, allowed the furnace to go unfixed for approximately nine months and when my aunt was vulnerable due to compromised health had my aunt , change the deed to her house to reflect joint ownership with my sister. Given the fact that my sister essentially defrauded my aunt and continues to defraud my mother , never provided any compensation to me for caring for my mother for a year and my aunt for over two years, is there any way I can seek to try to take away my sister's power of attorney over my mother? Also my sister was half owner of my Aunt's house. normally in Kentucky the house would simply pass directly to my sister due to a "survivorship" clause? However I heard my sister bully my Aunt into not making a will, when my sister found out about this "survivorship" clause. My Aunt has/had no other tangible assets besides her house, seeing that my sister cleaned approx. 10, 000 d. out of my Aunt's bank account. Is there any way I can petition the probate court to put the house in probate? Can I make a case that I might be entitled to something since I took care of my Aunt for over two years and up until about four months before her death, was still my Aunt's primary caregiver? Also my mildly mentally disabled brother still lives in my Aunt"s house. Can I petition the court on his behalf, knowng that i heard my aunt declare that she wanted to provide not only for myself but also for my brother after she was gone. Also even if no one else heard my aunt discuss her desire to make a will to provide for myself and my brother, wouldn't there be enough of a "circumstantial" case that could bemounted by deposing family members to testify that my Aunt and other members of my family have always said they would do anything they could to provide for my brother ? My main objective is simply to have this matter probated, because my sister is now threatening to change the locks on my Aunt's house if I go over to see my brother and then subsequently to file trespassing charges against me if enter my aunt's house for any reason. Presently I also have several possessions in my aunt's house. Should I attempt to remove those possessions before the locks are changed? Or not needing these possessions immediately, should I let my sister go ahead and change the locks and then insist that i need to get my possessions out of there and file criminal charges against her for possession of stolen property if she does not let me clear out my possessions?. Please help me. I am already at my wits end with this evil woman,:but on the other hand I am prepared to fight evil to the bitter end, because i believe that once her treachery is exposed tro the light of day she will be so absolutely disgraced by famly and public opinion against her, that even if she would win she would really lose because she would allow her evil and her perfidy to see the light of day even better than anything I could witness or attest to. if this inquiry cannot be answered completely, my most immediate concern is with the disposition of my aunt's house/estate and any rights i may have to petition the probate court.
