I am currently having a problem with a 3rd party collection agency named First Revenue Assurance out of Glendale Colorado.

First and foremost they contacted me before i recieved a validation of the debt. I requested them to send me this they were very rude to my wofe and myself. They said that I was just stalling on the debt and that they would just notify the creditor that I refused to pay the debt. Which is not the case I just want to make sure that I know what im paying. Then today i get in the mail a piece of paper with their name and address the date my name and address. It has who the debt is owed to and how much it is. Then it says to whom it may concern as of 11/12/09 the balance on the above listed account is and the dollar amount and THATS IT. Has nothing on it about if I want to dispute the debt who I should contact. Not to mention its not on letterhead. They claim they have sent me a formal validation letter, but I have not seen it..... Anyone have any information on what I should do?

Thanks,

Dennis

Send back a letter to them that says: This is NOT my debt. I demand that you cease and desist calling me or contacting me except to inform me if you are filing suit against me. That should stop them from contacting you. If it is a real debt they will eventually file suit against you and you can settle it before it becomes a judgment.

But, the question is. Is this really considered a validation letter means they didnt put anything on it from the FDCPA or who I need to contact if I want to dispute it. Not to mention that its not even on letterhead. I could have printed this off from my computer and sent this to someone to try and get money. I thought there is certain steps they have to tak with the validation letter or its not valid. If its not valid should I wait the 30 days, because I told them when I spoke to them that they had 30 days to get me a validation letter or else I am assuming the debt is not mine. Then if they contact me after 30 days they really dont have a leg to stand on in court. Am I correct?

The validation letter has no relevance to whether they have a case in court. The validation letter is required before they can put it on your credit. My advice still stands. Reject their validation letter by saying all the things you said: its not on letterhead, it doesn't have the proper information to validate the debt, and you don't think the debt is yours. The second part of my advice was to issue a cease and desist demand so they don't continually call and harass you. If you do owe the debt and it is big enough, they will eventually sue you and if their paperwork is in order they will win.

I can't help you with that. Their lack of a good validation letter won't either.
