Rear end dispute, no ticket

I was rear ended about a month ago and now there is a dispute as to what happened. It happened in Texas. I did not have collision insurance, so my insurance company said they can't help me. The driver that rear ended me lied and told his insurance that I did something that I did not, and the insurance company now won't cover based on what he said because they say I did something illegal.
I have never heard this before, although I didn't do that, I didn't think it matter, and it's obvious by the damage on my car that he rear ended me, so there was no police report filed.
I am trying to decide on my next step. I think the damage falls under small claims court. But should I talk to a lawyer and find out what my options are?
 
Since the police weren't called, you are in a bad situation of your word against the other drivers. A consult with a lawyer would be your smartest move.
