I first posted this to small claims but now searching new forums came across this one.
I rented a 4 br duplex in GB, WI. My roommate signed a new lease with the landlord with new tenants. I signed a waiver to be release from my lease that started June 2008 a 12 month lease.
The landlords claim that they will not refund the security that I paid in full 1000, 500 for the house and 500 for my roommate's pet. Condition upon move out will be same as move in, I am rarely hear.
My current roommarte has been moving in property of the new roommates since the beginning of August without my consent.
DO I have grounds for??
Taking my roommate and the new tenants to small claims for return of the full securities to me??
Charging them a storage fee for all of there belongings in the duplex prior the the start of their lease which is effective September 1st. I can't park in my two car garage as it is full of boxes, my basement, kitchen, living room has boxes in them, one of the other bedroom is already being set up with a new bunk bed.
Or can I take them to small claims for rent payment for the month of August??
My current roommate has only paid half of one months rent and if monies are not received by the end of the month like agreed upon, I will be taking him to court, but do I have basis to take the new tenants to court for monies owed to me.
