I just pray someone here knows what I need to do! I am a single father of three kids, I have had custody since 2004. When I won the ex moved to INdiana and the child support order was sent to them for enforcment. I gave her the state minimum and standard visitation every other weekend.
She stayed way behind in child support and has went over a year without taking a visit (was in prison for trafficing meth for a year and is on probation for another 3 yrs), but I felt sorry for her and let her talk me into moving to gallatin county kentucky which is near indiana.
She then continued the same behaviour, I filed a motion to review the child support in Gallatin County she didn't show up and they saw her as voluntarily unemployed and set it for minimum wage. She then lashed out by calling social services and alleging child abuse, she took the kids for a visit and coached them on what to say. The investigation even found evidence of coaching and ruled in my favor.
She got very far behind and filed a motion to review the visitation in Gallatin County, I agreed to swith it to two consecutive weekends instead of every other weekend. She then claimed that this visitation agreement set the child support back to the state minimum and drug me to another hearing to determine if that was so. They ruled she was wrong and had to pay, but I agreed from that date on to lower it by half on account of her hardship.
By that time I am having a hard time and start planing to move back to home county. (steel price shut down the mills) She objects and when she comes over to my house to pick up the kids sneaks and takes alot of pictures! She knew the day I was planning to move and made another social services complaint that was very heavy alleging drug abuse, neglect, unsanitary conditions. (winter storm knocked out power for a week I spent that week at a friends residence house was a wreck they came in 1 hour after power was on and 2 minutes after we got home) She is so devious she timed this report to coincide with the messiest day of my year lol. She also files for modification of visitation and custody.
Social services investigation again showed I was fine and the kids were not in any danger and gave me the OK to move. I was served with the court date for the visitation hearing the same day we left for home.
I moved and have been in Martin County now for 3 months but apparently they have the case in gallatin county still open. The child support case has been transfered here, I want to file now to have visitation amended and child support enforced (she owes 4600$). I want to file here in my our home county of martin of course.
Do I have to file a motion to transfer the open case to martin county? If so can I file that motion in Martin County? Or can I just file to amend the visitation without the case info from gallatin county?
Martin County Child support is giving me a run around saying they cannot file any motions or any warrants to collect the child support, they say they sent it to indiana and indiana has to do that. But gallatin county said the opposite when we lived there. Who is right?
I have to do this myself I am sorry this is so long I have to act quick before she tries to refile her motion in gallatin county, I will have a less favourable outcome there as here as me and the kids have spent most our lives here in martin county.
