taking a friend to court over $600 he owes me

Friend owes me $600 for his half of a trip we took to Miami last July. He stopped returning phone calls and text messages. Yea, what a friend right?

I filed a small claim against him and our trial is this march 2010.

I sent the claim to his job and I got a letter saying it was served in December from the courthouse. About a week later, I received a call from his employer saying they accidentally signed for it but they can't deliver it because this is a personal matter and that they are going to write a letter to the clerk saying it was a mistake on their part.

I received a copy of this letter that they sent and it said that they have spoke to me and that they made a mistake by signing for it since so much mail comes through there...eh whatever.

I have not heard from the courthouse or clerk

Is this something I should worry about on the date of the trial? I dont want the judge to see this letter and throw the case out because he was never served. My friend is aware I'm taking him to court through another friend but he doesnt know date and time etc....he doesnt even care to be honest and I have no intention to go back to court and send another subpoena.

Hes not going to defend himself or even show up.
 
Your claim won't be tossed, but you may have to serve the notice again and start over... however... you have plenty of time to serve the notice again BEFORE the court date and get him to show up.
