Transfer of ownership interest

I'm wondering if it's the right of my servicing company to file an assignment of mortgage in my town records without an affidavit of authority from the owner they are servicing.or showing there authority to do so? Also can my servicing company actually be assigned my mortgage and have the legal ownership rights to my mortgage and note?.

Mortgage loan contracts typically include the right to sell or assign the mortgage, without needing the consent of the borrower.

Every mortgage loan that I've ever had included that right.

Read your mortgage loan contract. It's probably in there.
