Actually, Uber treats its drivers as independent contractors, not employees. It pays the driver a share of the charge for each trip the driver does that is done through Uber. A fair number of Uber drivers also driver for its competitor, Lyft, which operates in much the same way.

Independent contractor just means that you are self-employed rather than an employee. A good discussion of what factors the law uses to determine if someone is an employee is found in IRS publication 15-A starting on page 7.

In the U.S. there are no requirements imposed by the law to become an independent contractor. All the contractor has to do is reach agreement with the company on the terms of the arrangement. i.e. compensation, what work will be done, etc.

An independent contract and employee are different work relationships. See the following. An employee is more of a permanent relationship where an employer has direct control over the employee's work. A 1099-MISC is the tax form for independent contractors and W-2 for employees.
