On friday night I was walking from the apartment next to mine back to my apartment carrying a can of beer which nothing had been drinken from it. I was stopped by two undercover city police and asked my age and information. I was then charged with under age possesion of alcohol. They messed up on my ticket saying that it was in violation of state, but my friend that was with my at the time who got the same charge they put in violation of city. I had nt drinken anything that night and I was with a 23 year old (I'm 19) at the time. Is there anything I can do to reduce the charge or have it dropped?
you've been charged with MIP - it doesn't matter that you drank or not the alcohol was in your hand, your possession and you're under 21 . It's a misdemeanor charge . I think you probably have to go to court for this and believed me it gonna cost you lots of money and time . The court they make money on those poor kids like you .
I know I'm supposed to go to court, and I have talked to a few of my friends that have gotten this charge. They all had to attend and ASAP class and anywhere from 12 weeks to a year of probation, but wasn't sure if maybe I could do something to reduce the charge or completely get it dropped. Or if maybe the officers error in writing my ticket could account for any reason that it should be dropped?
Well it is very complicate with the court system I don't know which one you going to but some of them you have to go for the arraingment then psi with a probaton officer then what ever they recommend the judge sentence you on the day you come back for sentencing . You can defend yourself by arguing that the cops didn't give you breathalyze test so you legally not drunk . They should give you a lesser charge than consumption of alcohol ( remember mic and mip are two different things) I think the pusnishment for mic is more severe than mip (?) I can give you an estimate of how much and what punishment you might get if you want .
