My daughter is living with the father of her 3 mo. old child he refuses to get a job tricked her into moving to Las Vegas where he invisioned himself as the next poker player star My daughter wants to come home to get a fresh start with her life he told her he could stop her from leaving the state I thought that he could only stop her from leaving the state if they were legally married .
This deadbeat dad signed away his parental rights to another child to keep from bein forced to pay child support! a real gem NOT! can he stop her from coming home they are not married he ;s very controlling making threats of her never being able to come home . as a mom and gandma I'm ready and willing to help my daughter start over with complete financial support for her and her 2 children. please help us
He told her oh she could leave but the children are staying with him and older child is not even his .
 
If legal paternity hasn't been established, then he cannot force her to stay. However, he can request the court to order paternity testing and file for visitation. In that case, he could prevent her from moving the child.
 
Was paternity established with the baby? Did he sign the birth paperwork? If so, mom may encounter some troubles if she moves. She should either see an attorney ASAP or go to court and file for custody with permission to move. If she can prove the move is in the childs best interest she might be able to move. She had a kid with this guy so he does have some rights. If he signed away his rigths to another kid then I have no idea why she would have a baby with him.

He is not going to be able to sign away his rights on this one. He can work out a visitation schedule with mom and your daughter is free to file for child support. If she moves out of state, the burden of helping out with transportation may fall on her.
