A Harker Heights man who posted an explicit video of his ex-girlfriend to social media in 2021, was sentenced this week to a term of deferred probation.
Isaias Josue Ocasio, 21, was indicted on Jan. 25, 2023, on a state jail felony charge of publishing intimate visual material. The public grand jury report was blank for Ocasio because he had not yet been arrested. He pleaded guilty on Feb. 15.
On Monday in the 264th Judicial District Court, Judge Paul LePak sentenced Ocasio to five years of deferred adjudication probation, according to Bell County court records. As a condition, LePak ordered that Ocasio serve 20 days in the Bell County Jail. Ocasio, who had been arrested on May 14, on a warrant after failing to appear for a previous sentencing hearing, already had served that time and was not in custody as of Tuesday.
On May 14, 2021, a Killeen police officer responded to Harker Heights High School where he spoke with a female student.
On May 13, 2021, Ocasio sent the post to the victim via text message.
The officer "reviewed the video, and (the victim) can be identified by her face on the video," police said. "The video also displays her genitals."
Police then spoke to Ocasio, "who advised he did not see anything wrong with making a video," according to the affidavit. "She gave me the video," Ocasio told police.

The student said that she "had been dating Ocasio and they had ended the relationship," according to an arrest affidavit. "She told the officer that he was angry about the breakup (and) that is when (Ocasio) threatened to post a video of her privates on (a social media site)."On May 13, 2021, Ocasio sent the post to the victim via text message.
