Even if such a body passed a "mask mandate", I don't believe it would pass Constitutional muster.
should a state want to enforce a mask restriction, all it need do is pass the appropriate legislation to do so.
I suspect the state legislators are aware of the powers they possess.
I imagine they've been further advised by their state's AG or the body's legal staff.
I'm quite sure of that too. However, my conclusion as to the Constitutionality of mask restrictions is quite different from yours. And thus I suspect that whatever legal advice the legislatures may be getting on that similarly will vary from state to state.
If the mask suggestions ever become law, I'm sure we'll see legal challenges leading to legal rulings.
