Which state would be preferable?

Married 35 years, husband moved out 2 years ago. Now starting on division of marital assests. We are both in NY State. I spent most of last winter working in FL. For this process as well as divorce, do I have to use laws of NY, or can I relocate and use the laws of a different state? If yes, which state would be most beneficial for the wife? Thank you.

Each state has its own residency requirements for filing for divorce. It can be anywhere from 3 months to a year immediately prior to filing. If you plan on moving to another state, you'll have to satisfy their residency requirements before you can file. You can check those requirements by googling.

If someone has already filed, then I believe that you won't be able to change jurisdiction.
